Johbs Terms & Conditions

Your Responsibilities. Johbs.com (or “Site”) may be used only for lawful purposes by individuals seeking employment and employers seeking employees. As one of the conditions of your use (“you”) of Johbs.com, you represent, warrant and agree that you will not use (or plan, encourage or help others to use) the Site for any purpose or in any manner that is prohibited by these terms, conditions and notices or by applicable law (including but not limited to any applicable export controls). It is YOUR RESPONSIBILITY to ensure that your use of the System complies with these terms, conditions and notices and to seek prior written permission from Johbs.com for any uses not permitted or not expressly specified herein. In connection with your use of our Site, you will not: 1. Transmit any message, information, data, text, software or images, or other materials ("Content") that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, hateful, racially, ethnically or otherwise objectionable that may invade another's right of privacy or publicity; 2. Impersonate any person or entity or otherwise misrepresent your affiliation with a person or entity; 3. Post or transmit any Content that you do not have a right to reproduce, display or transmit under any law or under contractual or fiduciary relationships (such as nondisclosure agreements); 4. Post or transmit any Content that contains a virus or corrupted data; 5. Delete any author attributions, legal notices or proprietary designations or labels that you upload to any communication feature; 6. Use the Site’s communication features in a manner that adversely affects the availability of its resources to other users (e.g., excessive shouting, use of all caps, or flooding continuous posting of repetitive text); 7. Post or transmit any unsolicited advertising, promotional materials, "junk mail", "spam,""chain letters," "pyramid schemes" or any other form of solicitation or any non-resume information such as opinions or notices, commercial or otherwise; 8. Violate any applicable local, state, national or international law; and 9. Upload or transmit any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights ("Rights") of any party. a. Post any incomplete, false or inaccurate resume information or information which is not your own accurate application (living individual seeking employment on a full-time or part-time basis on his or her own behalf). b. Respond to any employment opportunity on the System for any reason other than to apply for the job. Communications soliciting the employer's business by our competitors are prohibited. 12. Post to the System any franchise, pyramid scheme, "club membership", distributorship or sales representative agency arrangement or other business opportunity which requires an up front or periodic payment, pays commissions only (no significant salary), requires recruitment of other members, sub-distributors or sub-agents. 13. Delete or revise any material posted by any other person or entity. 14. Print out or otherwise copy or use any personally identifiable information about employees or business information about employers. Unsolicited e-mail, telephone calls, mailings or other contacts to posting individuals and companies are prohibited.  

Use the Site for any purpose that could damage, disable, or otherwise interfere with the operation of the Site or any other web site, or with any other person's or entity's use or enjoyment of this Site or any other web site. Johbs.com reserves the right in its sole discretion to investigate and take legal action against anyone who engages in any illegal or prohibited conduct or otherwise violates these Terms of Use, including without limitation, removing the User Content from the Site and/or terminating the offending User's ability to access the Site and/or use Johbs.com services No Professional Advice None of the services, materials, content, or information available on or through this Site constitutes employment, career, financial, legal, or other professional advice. You are encouraged to obtain advice tailored to your situation from a qualified professional if you have any questions regarding any such matters. Web Site Security Rules. Users are prohibited from violating or attempting to violate the security of Johbs.com, including, without limitation, (i) accessing data not intended for such user or logging into a server or account which such user is not authorized to access, (ii) attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization,(iii) attempting to interfere with service to any user, host or network, including, without limitation, via means of overloading, "flooding", "mailbombing" or "crashing", or (iv) sending unsolicited e-mail, including promotions or advertising of products or services, or (v) forging any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting. Violations of Site or network security may result in civil or criminal liability. Johbs.com may investigate occurrences which may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations. Your Grants. By submitting (e.g., uploading) Content to the Site, you automatically grant Johbs.com the royalty-free, perpetual, irrevocable, non-exclusive, transferable right and license to use, reproduce, modify (to comport with the Site), adapt, publish, distribute, translate, create derivative works from, distribute, perform and display such Content (in whole or part) worldwide or to incorporate it in other works in any form, media, or technology now known or later developed, without restriction or compensation. In addition, you warrant that all so-called "moral rights" in the Content have been waived. Johbs.com and its designees shall have the right, but not the obligation, in their sole discretion to edit, refuse to post, or remove any Content posted on the Site. Without limiting the foregoing, Johbs.com and its designees shall have the right to remove any Content that violates these Terms or are otherwise objectionable. Indemnification You agree to defend, indemnify and hold Johbs.com harmless from any third party claim, damages or demand, including reasonable attorneys' fees, relating to or arising out of your violation of these Terms, your representations and warranties, or your violation of any rights of another. Monitoring, etc. Johbs.com is under no obligation to monitor the information residing on or transmitted via this Site. However, you agree that Johbs.com may monitor the System Contents to (1) comply with any applicable laws, regulations or other government requests; (2) to operate the Site properly or to protect itself and its users and Subscribers; and (3) for such other purposes as it may deem reasonably necessary or appropriate from time to time. Johbs.com reserves the right to modify, reject or eliminate any information residing on or transmitted to its Site that it, in its sole discretion, believes is unacceptable or in violation of these terms and conditions. Information Collection The very nature of the service Johbs.com provides you requires that we gather, process, use and distribute information which you provide directly (e.g., name, physical address, e-mail address, resume), as well as information regarding the manner in which you use the System. Johbs.com cannot guarantee that your information will be prevented from being viewed by any particular party. If you have directly submitted information and would like us to remove it from our database, please contact us at the email address or phone number listed above and we will use reasonable efforts to delete your information from our then existing files. At your request, we will also make reasonable efforts to forward a similar request on to up to five Subscribers specified by you; however, we cannot control, or be liable for such efforts, or for any past, present or future action or inaction by any of our Subscribers. Johbs.com Liability. Johbs.com serves as a venue for employers to post employment openings and candidates to post resumes and does not screen or censor the listings offered. The Company is not involved in the actual transaction between employers and candidates. As a result, Johbs.com has no control over the quality, safety or legality of the employment positions or resumes posted, the accuracy, truth or validity of the listings, the ability of employers to offer employment opportunities to candidates or the ability of prospective employees to fill open employment opportunities or any User Content and makes no representations about any positions, resumes or User Content on Johbs.com. Johbs.com, via “Chat & Forums” forums tab provides a venue for individuals to network for professional purposes and Johbs.com does not screen or censor the User Content appearing in these forums. In addition, note that there are risks, including but not limited to the risk of physical harm, of dealing with strangers, foreign nationals, underage persons or people acting under false pretenses. You assume all risks associated with dealing with other users with whom You come in contact through Johbs.com and/or the other affiliated sites. By its very nature, other people's information may be offensive, harmful or inaccurate, and in some cases will be mislabeled or deceptively labeled. We expect that You will use caution and common sense when using Johbs.com and/or the other affiliate sites. Because user authentication on the Internet is difficult, the Company cannot and does not confirm that each User is who they claim to be. Because we do not and cannot be involved in user-to-user dealings or control the behavior of participants on Johbs.com, in the event that You have a dispute with one or more Users, You release the Company (and our agents and employees) from claims, demands and damages (actual and consequential, direct and indirect) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes. If You are a California resident, You waive California Civil Code d1542, which says: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor."

Content appearing on Johbs.com may contain inaccuracies or typographical errors. The Company makes no representations about the accuracy, reliability, completeness, or timeliness of Site Content. The use of Johbs.com is at your own risk. Changes are periodically made to Johbs.com and may be made at any time. You acknowledge and agree that You are solely responsible for the form, content and accuracy of any resume or material contained therein placed by You on the Johbs.com site. Employers are solely responsible for their postings on Johbs.com. The Company is not to be considered to be an employer with respect to your use of JOhbs.com and the Company shall not be responsible for any employment decisions, for whatever reason made, made by any entity posting jobs on Johbs.com.

Johbs.com cannot guarantee and does not promise any specific results from use of Johbs.com. No advice or information, whether oral or written, obtained by a User from Johbs.com or through or from Johbs.com or any of its affiliated sites create any warranty not expressly stated herein.

Disclaimer of Warranty THE COMPANY DOES NOT WARRANT THAT JOHBS.COM WILL OPERATE ERROR-FREE OR THAT JOHBS.COM AND ITS SERVERS ARE FREE OF COMPUTER VIRUSES OR OTHER HARMFUL MECHANISMS. IF YOUR USE OF JOHBS.COM OR YOUR ACCESS OF THE CONTENT THEREON RESULTS IN THE NEED FOR SERVICING OR REPLACING EQUIPMENT OR DATA, THE COMPANY IS NOT RESPONSIBLE FOR THOSE COSTS. JOHBS.COM AND ITS CONTENT ARE PROVIDED ON AN "AS IS" BASIS WITHOUT ANY WARRANTIES OF ANY KIND. Disclaimer of Consequential Damages IN NO EVENT SHALL THE COMPANY, ITS SUPPLIERS, OR ANY THIRD PARTIES MENTIONED ON JOHBS.COM BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, INCIDENTAL AND CONSEQUENTIAL DAMAGES, LOST PROFITS, OR DAMAGES RESULTING FROM LOST DATA OR BUSINESS INTERRUPTION) RESULTING FROM THE USE OR INABILITY TO USE JOHBS.COM WEBSITE AND JOHBS.COM CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Limitation of Liability. You agree not to resell or assign your rights or obligations under these Terms of Use. You also agree not to make any unauthorized commercial use of Johbs.com or any affiliated sites. General The Company makes no claims that the Johbs.com Content may be lawfully viewed or accessed outside of the United States. Access to the Johbs.com Content may not be legal by certain persons or in certain countries. If You access Johbs.com or other U.S.-based affiliated sites from outside of the United States, You do so at your own risk and are responsible for compliance with the laws of your jurisdiction. These Terms of Use are governed by the internal substantive laws of the State of Nevada, without respect to its conflict of laws principles. Jurisdiction for any claims arising under this agreement shall lie exclusively with the state or federal courts within Clark County, Nevada. If any provision of these Terms of Use are found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms of Use, which shall remain in full force and effect. No waiver of any term of these Terms of Use shall be deemed a further or continuing waiver of such term or any other term. Except as expressly provided in an additional agreement, additional terms of use for areas of Johbs.com, a particular "Legal Notice," or Software License or material on particular Web pages, these Terms of Use constitute the entire agreement between You and the Company with respect to the use of Johbs.com. No changes to these Terms of Use shall be made except by a revised posting on this page. Additional Terms of Use Certain areas of Johbs.com and affiliated sites are subject to additional terms of use. By using such areas, or any part thereof, You agree to be bound by the additional terms of use applicable to such areas.
